Overtime Rules

Unless exempt, EEs covered by the Act must receive overtime pay for hours worked over 40 in a workweek at a rate not less than time and one-half their regular rates of pay. The FLSA does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest, unless overtime hours are worked on such days.
Federal rule (listed above) applies except for specifically exempt categories. Those that apply to the restaurant use case include:
– Those working in service industry businesses that have turnover of less than $150,000 per year.
